Resolution
Summary:
A vote by the
House of Representatives on the Flag Protection Constitutional Amendment
could come as early as Tuesday, July 17, 2001. The resolution calls
for an amendment to the Constitution which states that "the Congress
shall have the power to prohibit the physical desecration of the flag
of the United States." The measure defines neither "desecration" nor
"flag" and does not itself prohibit any action. Instead, without fear
of such laws being ruled unconstitutional, it enables Congress to
enact flag-protection legislation.
On June 24, 1999,
in the 106th Congress, the House of Representatives approved an identical
resolution (H.J. Res. 33) by a vote of 305-124 (Roll Call Number 252).
However, the measure was not acted upon by the Senate.
