House to Consider Do-Not-Call Implementation Act (H.R. 395) 

On Wednesday, February 12, 2003, the House of Representatives is scheduled to consider the Do-Not-Call Implementation Act (H.R. 395) (To view the Full text of legislation ).  The establishment of a national “do not call” registry was established under the Telephone Consumer Fraud and Abuse Prevention Act. 

Soon consumers will be able to place their telephone numbers on this list, and it will be illegal to call a number listed on the registry by most telemarketers.  The registry will be implemented once the Commission receives Congressional approval for funding.  About four months later, consumers will be allowed to place their names on the registry. 

The Federal Trade Commission (FTC) will start enforcing the registry three months later, and fewer calls will be received by consumers who have enrolled.  The measure authorizes the FTC to promulgate regulations establishing fees to implement and enforce provisions relating to the “do-not-call’ registry of the Telemarketing Sales Rule.  This provision prohibits a telemarketer from calling an individual listed on a do-not-call registry.  Also, for fiscal year 2003 through 2007 the bill allows for such fees to be collected.
